The BOIP will take a decision as quickly as possible once the opposition investigation has been concluded.
If the opposition is deemed well-founded, the BOIP will refuse to register the trademark against which the opposition is directed either in full or in part, or the BOIP will shift to either a complete or partial deletion of the registration.
If the opposition is deemed unfounded, it will be rejected. The party found to be in error will be ordered to pay the other party € 1000.
If the opposition is partially awarded, there will not be any order to pay costs.
The BOIP’s decision becomes final once it is no longer subject to appeal, or, as the occasion arises, once the decision of the court of appeal is no longer subject to an appeal before the Supreme Court.
